These terms govern your use of this website and any purchase made through it. The site is operated by Pure Hope Restored, Inc. By browsing the site or placing an order you accept these terms. If you do not accept them, please do not use the site.

Eligibility

You must be at least 18 years of age, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the payment method used is yours or that you are authorised to use it.

Products, descriptions and pricing

We describe every item as accurately as we are able, including fabric, fit and measurements where given. Screens render colour differently, so slight variation between a photograph and the item received is normal and is not a defect.

Prices are shown in U.S. dollars and already include any applicable sales tax. We may change prices at any time, but a change never affects an order already accepted. Where an item is listed at a manifestly incorrect price we may decline the order and refund it in full rather than fulfil it; we will tell you if that happens.

Orders and acceptance

Placing an order is an offer to buy. The order confirmation email acknowledges receipt of that offer; the contract is formed when we dispatch the item. We may decline or cancel an order where the item is unavailable, where the delivery address falls outside the area we serve, where payment cannot be verified, or where we reasonably suspect fraud. If we cancel, we refund in full.

Stock figures shown on the site are maintained as accurately as we can, but an item may sell out between the moment you add it to the basket and the moment payment completes. In that case we contact you and refund in full.

Payment

We accept Visa, Mastercard, PayPal. Payment is taken through our payment processor; card details are entered on the processor's systems and are never stored by us. Placing an order authorises us to charge the total shown at checkout, including any shipping charge.

Shipping, delivery and risk

Delivery estimates, handling times and shipping charges are set out in our Shipping Policy, which forms part of these terms. Estimates are estimates, not guarantees. Risk of loss passes to you on delivery by the carrier; our handling of lost and damaged parcels is described in the Shipping Policy.

Returns

Returns and refunds are governed by our Return Policy, which forms part of these terms. Nothing in these terms limits rights you hold under consumer protection law that cannot lawfully be excluded.

Intellectual property

The content of this site — text, photographs, graphics, logos and layout — belongs to Pure Hope Restored, Inc. or its licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal use. You may not copy, republish, sell or use the content commercially, or use our name or marks, without our written permission.

Acceptable use

You agree not to use the site unlawfully; not to attempt to gain unauthorised access to any part of it, to any account, or to the systems behind it; not to interfere with its operation or security; not to place fraudulent orders; and not to extract data from it by automated means without our written permission.

Content you submit

Where you submit content to us, such as an enquiry or a product review, you confirm it is yours to send and does not infringe anyone's rights, and you grant us permission to use it in connection with operating the store. We may remove content that is unlawful, misleading or abusive.

Third-party links

The site links to third parties such as payment processors and carriers. Those sites are governed by their own terms and privacy policies. We do not control them and are not responsible for their content or practices.

Disclaimers

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error free, or that the content is complete and free of inaccuracy at all times. To the fullest extent permitted by law we exclude implied warranties, except any that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount paid for that order. We are not liable for indirect or consequential loss, including lost profits, lost opportunity, or loss arising from a delivery that arrives later than an estimate. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.

Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of the site.

Governing law

These terms are governed by the laws of the State of ID and the federal laws of the United States, without regard to conflict of law rules. Disputes are subject to the courts serving that location, save where consumer protection law gives you the right to bring proceedings elsewhere.

Severability and waiver

If any provision of these terms is found unenforceable, the remaining provisions continue in force. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

Order confirmation and communication

Transactional email — order confirmation, dispatch and tracking, and messages about a return — forms part of the service and is sent whether or not you subscribe to marketing. Please keep the address on your order current; we are not responsible for messages that fail to arrive at an address entered incorrectly.

Reviews and testimonials

Where you submit a review it must reflect your own experience of the item. We publish reviews as written, subject to removing content that is unlawful, abusive, or unrelated to the product. We do not write reviews ourselves, and we do not pay for them.

Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, natural disaster, fire, labour action, carrier network failure, civil disruption, or government measures. Where such an event delays an order we will tell you and, where it cannot be fulfilled, refund it in full.

Dispute resolution

If something goes wrong, please contact us first: most problems are resolved by email within a day or two. Where a dispute cannot be resolved informally, it is dealt with under the governing law set out below. Nothing in this section removes your right to bring a claim in a small claims court.

Assignment

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a successor in the event of a merger, acquisition or sale of assets, provided your rights under these terms are not reduced.

Accessibility

We aim to keep this site usable with a keyboard and with screen readers, and to maintain sufficient colour contrast. If any part of the site presents a barrier to you, write to us and describe what happened; we treat accessibility reports as defects and fix them.

Language

These terms are written in English, and English is the governing language of any translated version. Where a translation conflicts with this text, this text prevails.

Entire agreement

These terms, together with our Shipping Policy, Return Policy and Privacy Policy, form the entire agreement between you and us concerning your use of this site and any order placed through it, and replace any earlier understanding on the same subject.

Changes to these terms

We may amend these terms. The date at the top of the page shows when they were last changed. The terms in force at the time of your order are the terms that apply to it.
